Introduction

  • No purchase, payment or other financial contribution is necessary to enter or win the Competition and a Postal Entry is available for the Competitions.
  • Tickets for the Competition can be purchased up to 23:59 on the Closing Date. Postal Entries must be received by 23:59 on the Closing Date to be entered into the Draw.
  • The Winner of the Prize will be the Entrant whose details are randomly Drawn on the Draw Date by our independent scrutineering partners, Civica Election Services.
  • Customers who pay the Entry Fee will be emailed their receipt and tickets and may also find their tickets in their (optional) Account.
  • Customers who choose the Postal Entry will find their tickets in their (optional) Account following an administration period but cannot be emailed a receipt.

Terms & Conditions

  • By submitting an Entry, Entrants are confirming that they have read these Terms & Conditions and agree to be bound by them.
  • The Promoter reserves the right to amend these Terms & Conditions at any time and for any reason, with immediate effect upon publishing the amendments on the Website.
  • These Terms & Conditions shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoter.
  • Each Entrant should retain a copy of these Terms & Conditions as at the date of their Entry for their future reference.
  • The Promoter reserves the right to disqualify any Entrant (entirely at their own discretion) if there are reasonable grounds to believe the Entrant has acted in breach of any of these Terms & Conditions.

Entrants

  • All Entrants must be over 18 and resident in the UK.
  • Each Entrant must provide all contact details requested by the Promoter (which must include a valid email address), which will be used as follows:
    • to notify Winners and Runners-up
    • to administer the Website and conduct the Competitions
    • to post the Winner and Runner-up name and town of residence on the Website and in Competition publicity to comply with the Privacy Policy .
  • Entrants authorise the Promoter to enter their personal details into their database and to use the information in accordance with the provisions of the Data Protection Act 1998 and subject to the terms of the Privacy Policy.
  • The Entrants and the Promoter also recognise that the Promoter may (either by choice or at the request of a third party) disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.   • All Entrants are solely and completely responsible for providing the Promoter with accurate and current contact details. Promoter will be in no way liable for any failure or inability to make contact with any Entrant due to any errors, omissions or inaccuracies in the contact details provided.
  • By entering the Competition, Entrants warrant that all information which they submit is accurate, true, current and complete.
  • All Entries will be electronically recorded by the Promoter and accessible via the (optional) Entrant’s Account. Valid Postal Entry submissions will take a processing time before being visible via the (optional) Entrant’s Account.
  • The Competitions is open for entry only to private individuals (i.e. not companies or businesses) aged 18 or over, excluding:
    • the Promoter, their immediate family, or employees;
    • and anyone else connected with the development or operation of the Website or the conduct or administration of the Competition in any way, shape or form;
    • and the members of the immediate families or households of the above.
  • By entering the Competition, Entrants confirm that they are eligible to do so and eligible to claim any Prize awarded. The Promoter may require any Entrant to provide evidence that they are eligible to enter the Competition, and any Entries from Entrants who are found to be ineligible will be void without refund.
  • Entries are accepted from individual entrants only. No joint submissions will be accepted.
  • If any Entrant, at any time prior to the end of the Competition, deletes their Account, any Entries held by that Account will also be removed from any current or future Draw. Deleting an Account is different from logging out, which will not remove any Entries. Deleting an Account requires 2-step verification for security. Any Entries removed from any Draw due to Account deletion will not be re-instated and refunds will not be provided.

Entries

  • All Entries must be in English.
  • There is no limit to the number of Entries that any one person can make via the Website.
  • No purchase, payment or other financial contribution is necessary to enter or win the Competition; the Postal Entry is available for the Competitions.
  • Valid entries are those from eligible Entrants, made either via the Website or via the Postal Entry method.
  • At the Promoter’s sole discretion, Entrants may redeem a voucher code or credit provided to the Entrant under one of the Promoter’s promotional schemes. Such Entries will have the same status as Entries paid in cash except that they will not count towards the calculation of the Required Value.
  • Payments will only be accepted in pounds sterling.
  • Payments are processed by bankful.com (the Payment Processor) and the Payment Processor’s Terms & Conditions apply to payments.
  • Card details are processed by the payment processor; we don’t see or store any card payment details.
  • The Promoter does not accept responsibility for Entries which they do not receive due to failures of any kind. Only proof of Entry as recorded by the Website’s systems is accepted.
  • An Entry shall be declared void (without any refund being given) if the Entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the Website; or (e) amending, or unauthorised use of, any of the code that constitutes the Website.
  • The Promoter will not accept Postal Entries that are:
      • from countries outside of the UK, or
      • automatically generated by computer, or
      • illegible, have been altered, reconstructed, forged, tampered with or are incomplete.
  • All Postal Entries will become the property of the Promoter on receipt and will not be returned. Entries via this method will not receive notification of their ticket; instead, the Entrant must check their Account online.
  • All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date.
  • By entering into the Competition, all Entrants acknowledge that any paid or free entries they make do not guarantee in any way that they will win the Prize.
  • Only completed Entries will be entered into the Competition.

The Draw

  • The Draw to determine the Winner(s) and any Runner(s)-up will be made on the specified Draw Date.
  • The Winner will be determined and the Prize(s) awarded as specified on the Website and in accordance with these Terms & Conditions.
  • The Winner of the Prize will be the Entrant whose details are randomly Drawn on the Draw Date by our independent scrutineering partners, Civica Election Services.
  • The Promoter shall take all reasonable steps to ensure and preserve the random nature of all Draws but shall not be required to comply with any particular regulatory or other standards in this respect. The Draw shall be managed and verified by a third-party (Civica Election Services) who is independent of the Promoter.
  • The Promoter’s decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner as described above.
  • If by the Closing Date the value of the actual Entries received is less than the Required Value, the Promoter may, at their sole discretion, extend the Closing Date by up to 2 months. If the Required Value is still not achieved following the extension, the Prize Fund will be awarded in place of the Prize and distributed to the Winner.
  • If any Winner or Runner-up cannot be contacted by the Promoter within 21 days of being notified of their status as the Winner by email and/or telephone to the contact details submitted in their Entry, the Promoter shall be entitled to award the prize to the Entrant next Drawn, with the effect that the first Runner-up (as applicable) would become the Winner, and so on. At the Draw, additional / reserve Entries will be Drawn but not actioned or disclosed until required to facilitate this alternate Winner / Runner-up arrangement. Any alternate Winner or Runner-up shall likewise comply with the above 21-day contact requirement.
  • The Winner will be required to forward a copy of their passport or driving licence to the Promoter to prove their identity and, in the event of an online Entry, show that their Entry was made using a valid debit/credit card belonging to the Entrant or used with the express authorisation of the card holder.
  • In the event that the Promoter reasonably believes that there may be a lawful impediment to awarding a Prize to a Winner or any Runner(s)-up, the Promoter may suspend making such award until the legal issue is resolved, or if, in the reasonable opinion of the Promoter such issue cannot be resolved, to award that prize to the Runner-up.
  • The Promoter shall only deal with any Winner or, as applicable, Runner(s)-up or their estate (in the case of their prior death), and no prize in the Competition is transferable.

The Prize

  • The Promoter is authorised by the property owner to offer the property as a Prize in the Competition.
  • The Promoter does not in any way guarantee the value of the Prize.
  • The Promoter makes no representation or warranty as to the valuation of the Prize, its structural or cosmetic condition or its ability to be sold. Entrants should make and rely on their own enquiries and legal advice about the Prize before entering the Competition.
  • The Prize will be transferred by the Promoter to the Winner of the Competition free from all mortgages, charges and other encumbrances, at the Promoter’s expense and including all fees, charges and taxes relating solely to the Property. The Promoter will not be liable for any liabilities that accrue as a result of the transfer of the Property due to any of the Winners other assets, savings or income, and nor will the Promoter be responsible for any ongoing property maintenance or running costs following transfer of the Prize to the Winner.
  • The Winner agrees to media coverage following the Draw, which includes but is not limited to being featured in a newspaper article and being featured in social media posts. The Winner shall cooperate with and participate in the Promoter’s reasonable publicity requests.
  • The Winner agrees to allow the Promoter to display his or her name on the Website in accordance with the Privacy Policy. The name, age and town of residence of the Winner will be posted on the Website for the purposes of announcing the Winner of the Competition within 24 hours of the Winner being determined.

General

  • The Competition is operated by the Promoter.
  • The Promoter is a member of the Property Redress Scheme, more information about which can be found at www.theprs.co.uk.
  • Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to the Competition.
  • The Promoter shall not be a trustee of any Entry Fees received.
  • The Promoter reserves all rights to disqualify Entrants if their conduct is contrary to the spirit or intention of the Competition.
  • The Promoter reserves the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoter will return the Entry Fees to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by an Entrant). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.
  • The Promoter accepts no liability for errors or omissions contained within the description of the Draw Prizes or for any other description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of the Website.
  • The Competition, its administration and all associated activities shall be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
  • The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.
  • Insofar as is permitted by law, the Promoter, their agents or distributors will not in any circumstances be responsible or liable to compensate any Entrant or accept any liability for any loss, damage, personal injury or death occurring as a result of submitting an Entry or in relation to the Prize except where it caused by the negligence or fraud of the Promoter, their agents or distributors, or that of their employees. The Winner’s statutory rights are not affected.
  • Save for death or personal injury the Promoters will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoters, nor will their servants or their agents in developing, planning and Administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize
  • The liability of the Promoter to each Entrant is limited to the aggregate value of the Entry Fees paid by that Entrant.
  • The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this Website.

Definitions

Throughout these Terms & Condition, singular terms shall be considered plural, and plural terms shall be considered singular.

Closing Date means the date on which the Competition closes.  Any Entries received after 23:59 on the Closing Date will not be entered into the Draw. The Closing Date for each the Competition will be clearly displayed on the Website.

Competition means the Competition operated by the Promoter to which these Terms & Conditions apply, wherein the Entrants submit Entries via the Website www.kerbappealraffle.co.uk. Each Competition will run for a period of time as specified on the Website, following which there will be a Draw to determine the Winner.

Draw or Drawn means the process by which the Winner of the Competition (and where applicable, any Runners-up) is selected. 

Draw Date means the date on which the Draw takes place.  This will be up to but no later than 21 days after the Closing Date of any the Competition and at the sole discretion of the Promoter.

Entrant means any person over the age of 18 (not including a limited company, partnership or limited liability partnership) who validly submits an Entry to the Competition, in accordance with these Terms & Conditions.

Entrant’s Account means an optional and free-to-create online Kerb Appeal Raffle account, created using personal information, such as name, email address and telephone number or by using a Facebook or Google login, and processed in accordance with the Promoter’s Privacy Policy. The Account will display information pertinent to the Competitions, such as Tickets and account information.

Entry means a validly submitted and completed entry by the Entrant through the Website or Postal Entry in order to obtain an opportunity to win the Prize.

Entry Fee means the entry fee payable as a condition of submitting Entries online only.

Postal Entry is the means of entering by post rather than paying online. A full explanation of the Postal Entry requirements can be found in the FAQs on the Website at https://kerbappealraffle.com/faqs/

Privacy Policy means the Privacy Policy at https://kerbappealraffle.com/privacy-policy-2/

Prize means the property advertised on the Website, to be awarded to the Winner subject to the Draw (unless the Required Value is not achieved).

Prize Fund means the cash  fund offered instead of the Prize where the actual value of the Entries is less than the Required Value.  The Prize Fund is calculated as the cash value of the actual Entries less 30% (to cover operational costs).

Promoter means Kerb Appeal Raffle Limited, company number 15637891, whose registered office address is 20 Wenlock Road, London N1 7GU

Required Value means the minimum value of Entry Fees required to cover the value of the Prize and the Promoter’s operational costs.

Runners-up means additional / reserve Entries Drawn but not actioned or disclosed until required.  If a Runner-up becomes a Winner, then all references to Winner in the Terms & Conditions shall also apply to the Runner-up.

Winner means the Entrant corresponding to the first valid Entry Drawn on the Draw Date and in accordance with these Terms & Conditions.
